This suit is instituted by the Plaintiff seeking a decree of permanent injunction restraining Defendants No. 1 to 3 and all others acting on its behalf from using the marks 'GINGER TREE'/ , 'Ginger Tree Goveia Suites', 'Ginger Tree Boutique Hotel' and or any other mark that wholly incorporates Plaintiff's registered GINGER trademarks or any other deceptively similar trademark, either as a trademark, trade name, domain name as part of email addresses or in any other manner, amongst other reliefs.

have amicably resolved their inter se disputes and executed a Settlement Agreement dated 13.03.2026, incorporating the terms of settlement. 3.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, the suit is decreed in terms of the Settlement Agreement, which shall form a part of the decree and terms thereof shall bind the parties thereto.

Registry is directed to draw up the decree sheet. 5.

Suit along with pending application stand disposed of. 6.

Plaintiff is held entitled to refund of entire court fees in accordance with Court Fees Act, 1870.
