By way of the present appeal filed under Section 377(3) CrPC, the State/appellant seeks enhancement of the sentence imposed upon the respondent.

Learned APP for the State, on instructions, submits that the respondent has already expired way back on 07.08.2017. The death certificate and the verification report has been handed over in the Court today which is taken on record.

In view of the above, the appeal abates having been infructuous alongwith the pending application.
