The petitioner has filed the present petition, inter alia, impugning an order dated 14.03.2019, whereby the petitioner's application for parole was rejected in terms of Rule 1210 (ii) of Delhi Prison Rules, 2018. 2.

The nominal roll indicates that the petitioner's conduct in the jail was not satisfactory, as punishments had been imposed on him on 18.04.2014, 21.01.2017 and 12.04.2018.

It is seen that more than one year has elapsed since the last punishment was imposed on him and, therefore, the rigour of Rule 1210(ii) of the Delhi Prison Rules, 2018 does not apply. However, the status report indicates that the petitioner's mother has opposed the petitioner's release. She states that every time he come out of the jail, he creates problems for her.

In view of the above, this Court had adjourned the matter to enable the learned counsel appearing for the petitioner to obtain instructions whether the petitioner could reside at any other place (other than the residence of his mother) on his release. However, learned counsel appearing for the petitioner is unable to indicate any such address. 5.

In view of the above, the present petition is dismissed. However, it will be open for the petitioner to apply for parole afresh indicating an alternative address where he would reside after his release. 6.

Needless to state that if any such application is made, the same would be considered in accordance with law.
