CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

O R D E R

% 28.02.2018 1.

By this petition, the petitioner seeks quashing of FIR No.05/2010 under Sections 448/380/506/411 IPC, Police Station Jamia Nagar, based on a settlement.

2.

Parties were referred to Mediation before the Mediation Centre, Saket Court by the Trial Court.

3.

Parties have resolved their disputes through a Settlement. The Settlement Agreement dated 09.10.2014 has been executed between the parties.

4.

Respondent No.2 is present in Court in person, represented by counsel and identified by the Investigating Officer. He confirms that Crl.M.C.760/2018

he has settled the disputes with the petitioner through the process of Mediation and he does not wish to press his complaint any further. 5.

In view of the above and keeping in view of the fact that the parties have resolved their dispute through Settlement Agreement dated 09.10.2014 and respondent No. 2 does not wish to press his complaint, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would be expedient to quash the subject FIR and the consequent proceedings emanating therefrom.

6.

Accordingly, FIR No.05/2010 under Sections 448/380/506/411 IPC, Police Station Jamia Nagar, and the consequent proceedings emanating therefrom are hereby quashed.

7.
