O R D E R

The petitioner has filed this petition under Section 29A of the Arbitration and Conciliation Act, 1996 ["the Act"], for extension of the mandate of the Arbitral Tribunal, which is adjudicating the disputes between the parties under a Service Agreement dated 05.12.2018. 2.

The Tribunal was constituted by an order of this Court dated 08.03.2022 in ARB.P 142/2022.

It is submitted that the Tribunal's jurisdiction was challenged by an application of the respondent under Section 16 of the Act, which was disposed of by order of the Tribunal dated 02.01.2023, against which the petitioner herein filed ARB. A. (COMM) 4/2023, which was dismissed on 29.01.2024. It is stated that, as a result of these proceedings, arbitration did not proceed and is still at the stage of evidence, pleadings having been completed.

Mr. Kartik Nagarkatti, learned counsel, enters appearance on behalf of the respondent and has no objection to the extension sought, but disputes the contents of the petition.

The petition is, therefore, allowed and the mandate of the Arbitral Tribunal is extended for a period of one year from today. The pending application also stands disposed of.
