The petitioners, forty-five in number, have filed this writ petition under Article of the Constitution, seeking a direction for regularisation of their services in Sansad Television [respondent No. 1 herein].

The petitioners' services commenced with their appointments in the Lok Sabha Secretariat. They are now engaged as 'Consultants' with Sansad TV. The petitioners claim that they were appointed between 2006 and 2016, and were engaged in Lok Sabha TV until Lok Sabha TV and Rajya Sabha TV were merged in the year 2021 to create Sansad TV. According to petitioners, their original appointments were by way of a regular recruitment through advertisement.

The petitioners have sought regularisation by representation dated 11.09.2023, which has not been answered. Alongwith the writ petition, they have also filed certain judgments, including the judgment of the Supreme Court in Jaggo vs. Union of India & Ors., [SLP (C) No. 5580/2024, decided on 20.12.2024], which elaborates upon the condition in which regularisation can be granted.

According to Mr. Sandeep Kumar Mahapatra, who appears for respondent No. 1- Sansad Television, and respondent No. 2- Rajya Sabha Secretariat, on advance notice, the petitioners were only contractual employees and their contracts have been extended for various periods of time, lastly in July 2024 for a period of one month until further orders. They remain in service.

Having regard to this position, the petitioners are directed to file a comprehensive representation within two weeks from today, which may be considered by respondent No. 1 in coordination with the Rajya Sabha Secretariat and Lok Sabha Secretariat, within a period of eight weeks thereafter.

The writ petition, alongwith the pending application, is disposed of with these directions, reserving the rights and contentions of the parties.
