The Petitioner has approached this Court for a direction to the Respondent to carry out mutation/substitution of name in respect of the Property bearing No. C-54, Nizamuddin (East), New Delhi. 2.

The facts as narrated in the writ petition reveals that a deed of conveyance regarding the said property was issued in the name of late Smt. Parkash Kaur, who passed away in the year 1988 leaving behind three sons, had bequeathed the property in equal shares by way of a registered Will dated 09.11.1974.

Mutation/ substitution was applied for by the three sons of Smt. of the Petitioner herein.

It is stated that the father of the Petitioner, Mr. Kewal Krishna Juneja, was occupying the second floor of the property. The father of the Petitioner passed away on 18.01.2023 and the Petitioner sought mutation / substitution in respect of the second floor of the property. The said application was filed on 01.08.2023.

It transpires one Deepak Juneja, son of Mr. Krishan Juneja, the brother of father of the Petitioner herein, had applied for the mutation in respect of the said property. Objections have been filed against the said application. The issue regarding mutation is, therefore, at large before the concerned authority being the L&DO, Nirman Bhawan. 6.

Since the issue is pending before the L&DO for the last one year, the L&DO is requested to consider the objections and decide the issue regarding mutation as expeditiously as possible, preferably within eight weeks from today in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case.
