The suit is for partition of properties, purportedly belonging to late Smt. Prem Lata. The plaintiffs herein are the daughters of Smt. Prem Lata, while the defendants are her husband and sons. 2.

The defendants oppose the claim of the plaintiffs and assert that late Smt. Prem Lata had, vide Will dated 12.04.2009 (hereinafter 'the Will'), bequeathed all her movable and immovable properties in favour of defendant no.1. Therefore, according to them, there does not exist any property left in the name of late Smt. Prem Lata, to be partitioned. 3.

Defendant No.1 herein, Shri Bhagmal Singh, has instituted TEST.CAS. 81/2014, for the grant of probate in respect of the Will. This Court, vide a separate order has allowed the aforesaid petition and granted the probate sought.

Under the aforesaid circumstances, the present suit lacks merit. Accordingly, the same is hereby dismissed.
