CORAM:

HON'BLE MR. JUSTICE SANJEEV SACHDEVA

% 09.02.2018 Crl.M.A.2580/2018(exemption) Allowed, subject to all just exceptions.

CRL.REV.P.

117/2018 & Crl.M.A.2581/2018(stay), 2582/2018(calling TCR), 2583/2018(direction) Crl.M.A.2584/2018(delay in filing the petition for 1392 days) 1.

This is an application seeking condonation of delay of 1392 days in filing the Revision Petition impugning order dated 08.01.2014 directing award of maintenance to two children of the petitioner. 2.

The only reason given in the application is that the previous counsel of the petitioner advised him only to contest the divorce petition and not to impugn the order.

3.

There is an inordinate delay of 1392 days in filing the petition and no explanation is forthcoming.

Crl.Rev.P.117/2018

4.

The petitioner has also not arrayed two children in favour of whom maintenance has been awarded at Rs.1500/- per month. 5.

Since no explanation is forthcoming and there is also an inordinate delay of 1392 days in filing the petition, I find no ground to condone the delay.

6.

In view of the above, the application is dismissed. CRL.REV.P. 117/2018 Since the application seeking condonation of delay in filing the Revision Petition has been dismissed, the Revision Petition is also dismissed.
