The present Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the applicant/petitioner seeking preponement of the present petition.

Learned Additional Standing Counsel on behalf of the State submits that he has no objection if the present application is allowed. 3.

Considering the submissions made as well as no objection on behalf of the State, the present application is allowed and disposed. W.P.(CRL) 1544/2024 4.

In view of the Order passed in CRL.M.A. 27860/2024, the present petition has been taken up for hearing.

read with Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the petitioner seeking direction to the respondent to release him on Parole for a period of two months for getting his house repaired and in the meantime for arranging alternate accommodation for his family members.

It is submitted that on 12.02.2024, the petitioner made an Application for grant of Parole for a period of two months, however, the same has not yet been decided till date. Therefore, it is submitted that the petitioner may be granted Parole for a period of two months. 7.

The Status Report has been filed on behalf of the State, wherein, it is submitted that the construction of the house of the petitioner stands completed. The Statements of Shri Suresh Kumar and Shri Pradeep Kumar have been recorded who have stated that the construction of the house of the petitioner has been completed.

Submissions Heard.

Since the petitioner has sought the Parole for a period of two months for construction of his house, which has already been completed, no ground is made out for grant of Parole.

Accordingly, the present is disposed of in the above terms. 11.

The petitioner is at liberty to file a fresh Application for Parole in accordance with law, which shall be decided within one month by the concerned Jail Superintendent in accordance with Delhi Prison Rules, 2018. 12.

The next date of hearing i.e., 11.11.2024 stands cancelled.
