Petition under Section 482 Cr.P.C. read with Article 227 Constitution of India has been filed on behalf of the Petitioner with the prayer to set aside the Order dated 30.11.2019 vide which the Petitioner stand declared a Proclaimed Offender in FIR No. 0136/2012 registered under Sections 406/420/120B/174A IPC.

Briefly stated, FIR under Sections 406/420/120B/174A IPC was registered on 30.09.2012. As per the submissions of the Petitioner himself, the summons during the investigations were being sent at his wrong address. Eventually, he was declared Proclaimed Offender on 30.11.2019. Thereafter, he was arrested on 06.03.2021 and the Chargesheet got filed on 09.04.2021. The Bail was granted by this Court vide Order dated 17.07.2023. The charges have been framed by learned MM on 03.08.2024 against which the Petitioner has referred a Revision Petition, which is pending adjudication. 3.

under Section 174A IPC on the ground that he could not have been declared a Proclaimed Offender but only a proclaimed person in terms of Sections 82/83 Cr.P.C. Therefore, the Order is bad in law on the face of it. 4.

However, since as per the submissions of the Petitioner, framing of charges Order is under challenge before the Revisional Court. He is at liberty to take this objection as well as all other grounds taken in his Petition to challenge the framing of charge under Section 174A IPC. 5.

With this observation, the Petition alongwith pending Application, is hereby disposed of.
