W.P.(CRL) 1556/2025, CRL.M.A. 14525/2025 1.
The present writ petition under Article 226 of the Constitution of India has been filed by the Petitioner with the following prayers:- "a. Direct the respondent no. 1 and 2 to present the son of the Petitioner namely Mohit Kumar in this Hon'ble Court;
b. Direct the respondent no. 1 and 2 to take The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
appropriate action against the Respondent no. 3 and 4 for crating forge documents and solemnized illegal marriage with forge documents;
c. Pass order for nullity of the marriage between son of the petitioner namely Mohit Kumar and Kajal Sagar (Respondent no. 3) in the interest of justice; d. Pass such, further order(s) as this Hon'ble Court may deem fit and proper as per the facts and circumstances of this case."
2.
The boy and the girl have been produced in Court today. 3.
Learned Counsel for the Petitioner now seeks permission to withdraw the present writ petition.
4.
Needless to mention that the writ petition is complete abuse of the process of law where a complaint has been made by the father of the boy stating that the boy, who is 21 years of age, is in illegal custody of his wife. 5.
The statement given by the boy indicates that the boy and the girl met each other on Instagram in 2021-22. They developed a relationship and used to regularly go to a hotel in Govindpuri, Delhi where they used to make relationships. The statement also reveals that their parents came to know of their relationship and that with the help of an NGO and with the consent of both parties, both the Petitioner's son and the girl got married on 25.04.2025.
6.
It seems that now differences have arisen between the boy and the girl and instead of approaching the court of competent jurisdiction, the Petitioner has adopted a novel method of approaching this Court by filing a habeas corpus petition which according to this Court is an absolute abuse of the process of law.
The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
7.
This Court was inclined to impose costs on the Petitioner but considering the fact that the Petitioner is a bus conductor and it seems that the present writ petition has been filed only because of wrong legal advice, this Court is desisting from doing so.
8.
The petition is dismissed as withdrawn along with pending application(s), if any.
