By way of the present petition, the petitioners, who were the workmen/claimants before the Tribunal, are aggrieved by the order dated 05.12.2019 passed by the Presiding Officer, Industrial Tribunal-I, Rouse Avenue Courts, New Delhi, whereby the claim application was dismissed for lack of evidence on the part of the petitioners. 2.

Learned counsel for the petitioners submits that vide order dated 21.02.2019, the Tribunal framed the issues and directed the petitioners to file their evidence by way of affidavits. The matter was thereafter listed on 25.07.2019, on which date the petitioners were granted further time to file their evidence. It is contended that there are 24 workmen before the Tribunal, who required time to collate and file the requisite affidavits, for which reason the earlier directions could not be complied with. to have granted one further opportunity.

The aforesaid contentions are opposed by learned counsel for the respondents, who submits that the petitioners failed to file their affidavits despite the opportunities granted. It is further stated that the restoration application subsequently filed by the petitioners was also dismissed. 4.

At this stage, learned counsel for the petitioners submits that the requisite affidavits shall be filed within two months from today. 5.

Considering that the impugned order was passed after framing of issues, this Court deems it appropriate to set aside the impugned order and remand the matter to the Tribunal. The industrial dispute is restored to its original number. The matter shall be listed before the concerned Court on 09.03.2026 for further directions.
