Learned counsel for Petitioner, on instructions, seeks to withdraw this writ petition to approach the Central Administrative Tribunal in view of the judgment of the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261, and Section 14 of the Administrative Tribunals Act, 1985.

The writ petition is disposed of as withdrawn with liberty as prayed for. Needless to state that if an issue of limitation is raised, if and when the Petitioner approaches the Tribunal, the factum of pendency of this writ petition and the same having being bonafidely filed by the Petitioner before this Court may be taken into consideration by the Tribunal. 3.

Pending application also stands disposed of.
