% 30.01.2017 Crl.M.A. 1625/2017 Exemption allowed subject to just exceptions. BAIL APPLN. 176/2017 This is the second anticipatory bail application filed by the petitioner. The first one was dismissed for non-prosecution on 11th January, 2017. Learned APP for the State submits that the petitioner has already been declared a proclaimed offender vide order dated 7th December, 2016 by the learned Metropolitan Magistrate.

In view of the decision of the Supreme Court in Lavesh Vs. State (2012) 8 SCC 730 and State of Madhya Pradesh Vs. Pradeep Sharma (2014) 2 SCC 171 petitioner cannot be granted anticipatory bail as he has already been declared a proclaimed offender for a serious offence punishable with death or imprisonment of life.

Petition is dismissed.
