This writ petition is filed on behalf of the Petitioner under Article 226 of the Constitution of India seeking the following reliefs:- "I. Pass an appropriate writ, order or direction, directing the Respondents No.1 to 3 to take immediate action for sealing and demolition of "R. J. PUBLIC SCHOOL" i.e. PROPERTY BEARING KHASRA NO.692/2, BLOCK-L, STREET No.15, MAHIPALPUR, NEW DELHI-110037 (NEAR RADISSON BLUE HOTEL) (SUBJECT PROPERTY) in accordance with law, which is a high rise 6 floor building. II. Pass an appropriate writ, order or direction, directing the Respondents No. No.3 to ensure that the illegal encroachment made by the Respondent No. 5 to No.6 whereby which huge iron gates installed at both the side of the 15 Ft wide public road/ rasta whereby which has led to blockage of the public road/public rasta for the access of the general public be removed and the public road/ rasta 15 Ft wide be made accessible for the easy ingress and egress of general public.

III. Pass an appropriate writ, order or direction directing the Respondents No. 4 to ensure that the unrecognized and unauthorized school being run by Respondent No. 5 and No.6 under the name of R. J. PUBLIC SCHOOL be sealed and necessary legal action be taken against the Respondent No. 5 & No.6 as per law.

IV. Pass an appropriate Writ, order or direction directing Respondent No.1 to No.3 to ensure that no further illegal and unauthorized construction is permitted at "R. J. PUBLIC SCHOOL" i.e. PROPERTY BEARING KHASRA NO.692/2, BLOCK-L, STREET No.15, MAHIPALPUR, NEW DELHI-110037 (NEAR RADISSON BLUE HOTEL) (SUBJECT PROPERTY).

V. Pass an appropriate writ, order or direction, whereby which necessary legal action been taken against the Respondent No.5 to 6, whereby which willfully disobeying the order passed by LD. SDM, VASANT VIHAR, NEW DELHI dated 01/05/1999, whereby the Respondent No.5 and No.6 have encroached the public land despite going against the govt. orders." 2.

Learned counsel appearing for Respondent No.2/MCD submits that part demolition action was taken in respect of the school in question and status report has been filed in this regard. She further submits that the subject property was sealed and is currently lying sealed. 3.

Learned counsel for Respondent No.6 on the other hand, hands over a copy of an order dated 29.10.2025 passed by ATMCD, wherein it is directed that till the next date of hearing i.e. 23.02.2026, no coercive action shall be taken against the property of Respondent No. 6 pursuant to demolition order dated 19.03.2021 and sealing order dated 08.09.2021 at the same time observing that no encroachment on public land is being protected. The order is taken on record.

Since ATMCD is seized of the matter, this writ petition is disposed of giving liberty to the Petitioner to contest the appeal, if so advised.
