% 03.09.2019 The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure (Cr.P.C), 1973 for quashing of FIR No. 168/2019, under Section 363 of Indian Penal Code, 1860 („IPC‟), registered at police station- Narela, District Outer North, New Delhi and the proceedings emanating therefrom.
The petitioner had alleged in his complaint that some unknown person had kidnapped his daughter on 29.04.2019. However, on the same day, he had come to know that his daughter has married one Manoj on her own free will. He had also informed the IO about this fact on 01.05.2019. Learned counsel for the petitioner prays for quashing of the FIR on the ground that daughter of the petitioner is major and is living happily with her husband.
Learned ASC states that she has no objection since the daughter of the petitioner has married on her own free will.
Keeping in mind the facts and circumstances as detailed above, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 168/2019 under Section 363 IPC registered at Police Station Narela and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
