Learned counsel for the petitioner states that the petitioner was arrested on 07.03.2020 and the matter is still at the stage of framing of charge and the next date before the Trial Court is 24.10.2024. 2.

Learned APP for the state submits that the prosecution has cited two eye witnesses including the brother of the deceased and an auto driver. It is also stated by learned APP that the co-accused Deepak Pandit has already been declared a proclaimed offender.

After some arguments, learned counsel for the petitioner seeks leave to withdraw the present bail application at this stage as charge is yet not framed.

In view of the above, the bail application is dismissed as withdrawn.
