The present application has been filed by the petitioner/applicant under Section 438 read with Section 482 Cr.P.C. seeking anticipatory bail in FIR No.325/2024 registered under Sections 353/332/186/34 at P.S. Sagarpur, Delhi.

Learned counsel for the applicant submits that with respect to the alleged incident, the applicant has also lodged a complaint whereafter the present FIR came to be lodged. It is stated that even as per the allegations levelled in the FIR, the role of causing injury to the complainant is not attributed to the applicant but to her son.

Learned APP for the State, on instructions and while referring to the Status Report filed before the Sessions Court, submits that the applicant is an active bad character of the area and is involved in 20 cases. It is further stated that she had been externed and was permitted to be returned to the area in April 2024 only, whereafter the present incident took place. 4.
Keeping in view the aforesaid facts and circumstances including the fact that the role of causing injury to the complainant is attributed to applicant's son and not to the applicant, it is directed that in the event of arrest, the applicant be released on bail subject to her furnishing a personal bond in the sum of ₹25,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which she undertakes to keep operational at all times during the pendency of the trial. (ii) The applicant shall join the investigation as and when asked.
(iii) The applicant shall inform the concerned Investigating Officer about her current residential address. (iv) In case of change of residential addresses/contact details, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO.
(v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

(vi) The applicant shall regularly appear before the trial Court.
