% 26.02.2018 In view of the judgement of the Supreme Court in Kaliaperumal Vs. Rajagopal & Anr., (2009) 4 SCC 193 as well as the judgment/order passed by a Coordinate Bench of this Court in Shashi Garg Vs. M/s Shitiz Metals Ltd & Anr., CS(ÓS) No.585/2012 decided on 25th April, 2014, learned counsel for the plaintiff wishes to withdraw the present suit with liberty to file a fresh suit for recovery on the same cause of action.

With the aforesaid liberty, present suit and pending applications stand disposed of.

Registry of this Court is directed to issue to the plaintiff a certificate authorizing her to receive back from the Collector the full amount of the Court fee paid by her in the present suit. MANMOHAN, J FEBRUARY 26, 2018/KA
