1. This is an appeal filed under Section 37(2)(b) of the Arbitration and Conciliation Act, 1996 ("the Act") seeking to challenge the impugned order dated 10.02.2025.

2. The order is being passed at the stage of Section 17 of the Act and the observations contained therein are only prima facie in nature.

3. Parties agree that the observations are only prima facie and the final adjudication will be based on the evidence and the documents produced before the Arbitral Tribunal.

4. The Arbitral Tribunal shall adjudicate the matter on the basis of the evidence led by the parties and shall remain uninfluenced by any observations made in the order dated 10.02.2025.

5. With regards to the equipment concerned, para 103 of the impugned order is clear and needs no further clarification.
