By virtue of the present petition, the petitioner seeks cancellation of the registration of the mark bearing trademark application no. 2107742 registered in favour of respondent no.1 with respect to goods covered in Class 32.

Learned counsel for the parties submit that a Settlement Agreement dated 28.05.2025 has been entered into by the parties. Based thereon, CS(COMM) 407/2019 has already been compromised yesterday. 3.

Accordingly, learned counsel for the respondent no.1 has no objection if the present petition is allowed as the same is one of the terms of the settlement agreement filed by the parties yesterday in CS(COMM) The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. In view of the statement of learned counsel for the respondent no.1, the present petition is allowed.

Accordingly, the respondent no.2/ Trade Mark Registry is directed to cancel the registration of the trademark under trademark registration no. 2107742 registered in favour of respondent no.1 in Class 32. 6.

The present petition, alongwith the pending applications, stands disposed of.
