The petitioner has filed the present petition seeking quashing of the FIR No.163/2019 registered with PS Kirti Nagar. 2.

The said FIR was registered at the instance of respondent no.2. She alleged that she has been forcibly raped by the petitioner, while she was in an unconscious state as a result of being administered some substance in her cold drink. She has also alleged that the petitioner had taken her nude photographs and was blackmailing her.

The complainant has now filed an application stating that the allegations made by her are incorrect. The petitioner and respondent no.2 (complainant) are now married and are now residing together.

The petitioner has also placed certain materials to indicate that respondent no.2 was in close relationship with him. Clearly, if a false and vexatious FIR has been filed, the complainant is required to be prosecuted. 5.

At this stage, Mr Mohan, learned counsel appearing for the petitioner seeks to withdraw the present petition.

The petition is dismissed as withdrawn. All the pending applications are also disposed of.
