The petitioner has filed the present petition, inter alia, praying that the respondents be directed to supply a certified copy of the Will dated 09.08.2005 registered vide registration No. 20486 in additional book no. 3, volume no. 7415, on pages 81 to 81.

The petitioner had applied for a certified copy of the said will, however, the same has not been provided to the petitioner. In response to his application, the petitioner received the letter dated 11.06.2018 from the office of respondent no.2 (The Sub-Registrar - II) informing the petitioner that the records had been searched, however, the said deed was not traceable.

Plainly, the same is unacceptable. The respondents are bound to ensure that the copy of the documents registered is duly preserved and all necessary steps are taken in this regard.

In view of the above, the respondents are directed to conduct a proper

enquiry to search for the relevant document. If the document is not found, the respondents shall conduct a proper enquiry to ascertain the persons responsible for misplacing/loss of the said document and take further action against such officers in accordance with law. 5.

The petition is disposed of with the aforesaid directions. 6.
