% 14.08.2018 This petition seeking quashing of the FIR No.433/2006, under Sections 420/468/471/34 of Indian Penal Code, 1860 (IPC) of Police Station Shakarpur has been pending since February, 2016. The prime contention on the basis of which prayer for quashing is pressed is settlement of the dispute with the second respondent, the complainant of the case.
The counsel for the complainant, however, opposes the prayer in the petition submitting that grievances of the complainant have remained unaddressed as by the subsequent documents executed roof rights were denied, which was one of the bones of contention between the parties.
The learned Additional Public Prosecutor for the State also opposes the request on the ground the case involves serious offences such as forgery of collateral security, the prosecution having been proposed by charge sheet CRL.M.C. 449/2016
submitted in May, 2012 on which even the question of charge has not been considered till date because of the delaying tactics of the petitioners who have been summoned as accused.
In the above facts and circumstances, the prayer for quashing cannot be granted.
The petition is dismissed.
