Petitioner is opposite party No. 2 before the learned District Commission and is aggrieved by the manner in which it has been proceeded against ex-parte and its written statement has not been taken on record. 2.

The complainant i.e. respondent no.1 also appears in person. 3.

Since the issue involved is a very short one, both the sides were requested to exchange proposals for the purposes of amicably settling the matter and a pass over was, accordingly, given. 4.

Matter has been taken again and it is now informed that the matter has been amicably settled between the parties.

Petitioner herein i.e. Dell International Services India Pvt. Ltd has, without prejudice to it rights and contentions, agreed to refund a sum of Rs. 75,000/- towards full and final settlement with the condition i.e. respondent no.1shall hand over the laptop in question.

The next date before the learned District Commission is 17.07.2025 and it is agreed that the abovesaid refund would be made before the learned District Commission and, simultaneously, the laptop would also be returned, simultaneous with the abovesaid payment, before the learned District Commission.

Respondent No.1/complainant reiterates that he would hand over the laptop to the opposite party No.2 before the learned District Commission on 17.07.2025 and on receiving the abovesaid settled amount of Rs. 75,000/-, he would, unconditionally, withdraw his complaint. 8.

The matter stands settled in aforesaid terms. 9.

Parties are directed to appear and do the needful on 17.07.2025 before learned District Commission.

Petition stands disposed of in aforesaid terms. 11.

Pending applications also stand disposed of in aforesaid terms.
