o/o 22.07.2019 CRL.M.A. 30932/2019 In W.P.(CRLT1893/20l9 Allowed, subject to just exceptions.

W.P.(CRL) 1893/2019 AND W.P.(CRLI 1894/2019 By the instant petition, the petitioner, in effect, seeks grant of parole on account of a surgeiy scheduled to be conducted on his son. As per the status report that has come to be filed on behalf of State, the son of the Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

/ petitioner was admitted to hospital on 16.07.2019 and the surgery for rectum is now scheduled for 24.07.2019 and he would require, two units of blood. As per the nominal roll, as against the sentence of ten years in FIR No. 107/2011, the petitioner has undergone seVen years and more than nine months, while, in FIR No.83/2011 he was sentenced to seven years on 23.11.2017 and after deducting judicial period in the said case he has to undergo only five months and twenty one days after completion of sentence in FIR No. 107/2011. The petitioner, availed the parole lastly w.e.f. 28.05.2019 and surrendered on 26.06.2019 and in relation thereto, no misconduct has come to be pointed out.'

Taking into account the totality of the facts and circumstances, the petitioner is directed to be released on parole for a period of one month from the date of his release on his executing personal bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Jail Superintendent.
