A Criminal Misc. Petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed on behalf of the petitioner for quashing of FIR No.257/2019 Police Station Seelampur, under Section 135 I.E. Act, 2019 and all consequential proceedings emanating there from, in view of the Settlement with the Electricity Department. 2.

It is submitted that the FIR No.257/2019 under Section 135 Indian Electricity Act, Police Station Seelampur, District North-East dated 29.06.2019 was registered against the Applicant. Thereafter, S.C. No.913/2023 was registered and submitted before learned ASJ (Electricity), Karkardooma Courts, Delhi. During the pendency of the said case, a Settlement was arrived at between the Petitioner and Respondent No.2, wherein against the Bill of Rs.1,05,868/-, the Petitioner was offered to pay a sum of Rs.50,000/- in 5 equal installments of Rs.10,000/- each, which had The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. been accepted by Respondent No.2. In view of the said Agreement, the quashing of the FIR is sought.

The Order of the learned ASJ dated 08.11.2023 records about the Settlement of the civil liability on payment of Rs.50,000/- by the Petitioner. A No Dues Certificate dated 02.02.204 has already been issued by the Respondent No.2. The Affidavit in the form of Status Report has been submitted by Respondent No.2 Rahul Keshav, which is duly attested, wherein it is submitted that there is No Objection if the FIR is quashed. 4.

In view of the aforesaid and the Affidavit of Respondent No.2 recording the Settlement between the parties, the FIR No.257/2019 Police Station Seelampur, under Section 135 I.E. Act, 2019 and all consequential proceedings emanating there from are hereby quashed. 5.

The Petition stands disposed of along with the pending Applications.
