CORAM:

HON'BLE MS. JUSTICE JYOTI SINGH

O R D E R

% 30.09.2024 1.

After canvassing some arguments, learned counsel for the Petitioners fairly submits that the issues raised in the present petition are amenable to the jurisdiction of the Central Administrative Tribunal in view of the judgment of the Constitution Bench of the Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261 and Section 14 of the Administrative Tribunals Act, 1985 and thus seeks to withdraw the petition with liberty to approach the Tribunal. 2.

Petition is disposed of as withdrawn with liberty as prayed for. It may be noted that the petition was filed in the year 2020 bona fidely by the Petitioners and has been pending ever since. Therefore, while considering the issue of limitation, the Tribunal may look into the pendency of the petition in this Court. Pending application also stands disposed of.
