Court notice was issued to the Petitioner on 2nd August, 2022. The office noting reflects that Petitioner stood served on 15th September, 2022. Since then, the matter has been listed on multiple occasions, however, Petitioner has not appeared on any of those dates. Notably, on 21st September, 2023, appearance of Mr. Pankaj Kumar is noted for the Petitioner, which is evidently an error as Mr. Kumar represents the Respondent and not the Petitioner. Accordingly, Mr. Kumar's appearance will be recorded on behalf of the Respondent in the said order and the same is deemed to be corrected to that effect.

On 11th January, 2023, proceedings were adjourned as Mr. S. K. Bansal, counsel for Respondent, stated that the parties had arrived at a settlement and only a formal agreement, to that effect, was required to be executed. Ajay Amitabh Suman, counsel for the Respondent, yet again seeks adjournment on the ground of likelihood of settlement between the parties. However, since there has been no appearance on behalf of the Petitioner as noted in the orders referred above, the Court is not inclined to adjourn the hearing any further. The present petition is dismissed for default and for non-prosecution.
