The present application filed under Sections 483 read with 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks grant of interim bail for a period of 10 days on the ground of arranging finances to secure the admission of his minor son, aged around 3 years, to primary school. The Applicant is in custody in relation to proceedings emanating from 445/2023 registered under Sections 302/34 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959 at P.S. Jahangir Puri. 2.
Mr. Maninder Singh, Senior Counsel for the Applicant, submits that the Applicant is the sole breadwinner of his family and requests bail to secure his son's education and academic future. had previously filed an interim bail application before the Trial Court, which was dismissed on 26th September, 2023. A subsequent application for interim bail on medical grounds was also rejected by the Trial Court on 12th January, 2024. Aggrieved by this, the Applicant approached this Court in BAIL APPLN 483/2024, and by order dated 22nd March, 2024, this Court granted interim bail for two weeks on health grounds, due to the Applicant's deteriorating health. The Applicant further presses ongoing health issues, including chest pain, auditory problems, and inadequate medical care in support of his request.

Mr. Amit Ahlawat, APP for the State, strongly opposes the application, asserting that the Applicant is in judicial custody for a serious crime involving the murder of Bijender Yadav. He adds that there are several public witnesses crucial to the case, residing near the Applicant's residence, and there is a risk of the Applicant influencing these witnesses if released.

The Court has carefully considered the afore-noted facts and contentions but remains unconvinced. The Applicant had previously sought interim bail from the Additional Sessions Judge (ASJ-03), North District, Rohini, Delhi, on 28th April, 2025, on the same grounds urged today, but the application was rejected. The Sessions Court, in rejecting the bail application, rightly pointed out that there were several other family members of the Applicant who could assist in securing the admission of his son to school.

Additionally, it must be noted that matter is at the stage of charge and material witnesses are yet to be examined. Further, no change in circumstances have been pointed out that warrants the intervention of this Court.

The Applicant has also relied on order dated 22nd March, 2024 passed by this Court in BAIL APPLN 483/2024 to claim interim bail on the grounds of medical intervention. However, the Applicant has not provided any updated medical documents or evidence to substantiate his claims of health deterioration. In any event, even if the Applicant is suffering from any ailment, the Jail Superintendent shall provide appropriate medical care. 7.
In view of the foregoing, this Court is not inclined to grant the Applicant's substance.

Accordingly, the application is dismissed.
