The Petitioner was implicated in FIR No. 813/2014 dated 28th July, 2014 registered under Section 135 of the Electricity Act, 2003 at P.S. Uttam Nagar, District West.

During the pendency of the proceedings, the matter was resolved between the Petitioner and the Complainant, BSES Rajdhani Power Limited, before the Lok Adalat, as the Petitioner settled his civil liability. Consequently, the proceedings arising out of the FIR were stopped under Section 258 of the Code of Criminal Procedure, 19731 vide order dated 23rd December, 2021, passed by the ASJ, Special Electricity Court, Dwarka, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Counsel for Respondent No. 2 confirms that a No Dues Certificate has already been issued and nothing is due or payable in respect of the civil liability.

The Petitioner's grievance is that although the proceedings have been stopped under Section 258 Cr.P.C., the registration of the FIR acts as an impediment for issuance of his passport, as it reflects a criminal record. 5.

In light of the aforenoted facts and circumstances, and considering that this Court, in similar matters where civil liability has been settled and no objection is raised by the electricity company, routinely quashes the criminal proceedings, the Court finds it appropriate to exercise its jurisdiction under Article 226 of the Constitution of India. 6.

Accordingly, it is directed that FIR No. 813/2014 dated 28th July, 2014, registered at P.S. Uttam Nagar, District West, and all consequential proceedings emanating therefrom, are hereby quashed. 7.

Disposed of.
