At the outset, Learned counsel for the Respondents, objects to the maintainability of the present petition and urges that the Respondents have, in exercise of their right under the Arbitration Clause No. 50.3 of the work order, appointed Hon 'ble Mr. Justice (Retd.) Vinod Prasad as the Sole Arbitrator, pursuant to Petitioner's notice invoking the arbitration clause. Learned counsel for the Respondents further submits that in its notice dated 13th June 2019, although Petitioner has objected to the said appointment, the notice does not state any reason for the same. After some arguments, learned counsel for the Petitioner states that now since the Arbitrator has

entered upon reference, he would not like to press the present petition and would like exercise his remedies in accordance with law. Accordingly, the petition is dismissed as withdrawn.
