% 06.11.2019 Petitioner by this petition seeks a direction to the Respondents to refund the Earnest Money Deposit of Rs. 5,000/- submitted alongwith his bid.
Learned counsel for the respondent submits that the earnest money deposited had been furnished by way of demand draft and since demand draft got misplaced in the office of the NDMC, the same was never deposited and the NDMC never received money. He submits that the money remained with the Syndicate Bank which has issued the demand draft. He submits that an Indemnity Bond was furnished to the Syndicate Bank requesting them to remit the amount back to the account of the petitioner and an intimation by W.P.(C) 7521/2019
letter dated 20.09.2019 has been received from Syndicate Bank, GTB Nagar Branch, Kingsway Camp, Outram Line, Delhi that the amount of ₹ 5,000/- has been credited into Account No. 90331010002947 of M/s Sharma & Associates.
Learned counsel for the petitioner seeks leave to withdraw the petition.
