O R D E R

% 05.12.2025 Further to what was recorded in order dated 02.09.2025, Mr. S.C. Singhal, learned counsel appearing for the appellant as well as Mr. Vipin Nandwani, learned counsel appearing for the respondent jointly submit, that the parties have amicably resolved their dispute in the following terms: i.

That on 25.10.2021, the appellant had deposited a sum of Rs. 16 lacs, being 75% of the decretal amount in court. The parties have agreed that, of the amount now accrued alongwith the interest, the sum of Rs. 18 lacs be released to the respondent; and ii.

That the balance amount remaining with the court, alongwith uptodate interest, be released to the appellant. Counsel submit that the appeal may be disposed-of in terms of the above settlement.

Accordingly, the present appeal is disposed-of in the above terms, directing the Registry to release the sum of Rs. 18 lacs to the respondent; RFA 326/2021 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and the remaining amount alongwith interest upto-date to the appellant, within 02 weeks of the parties approaching the Registry for the purpose; after duly verifying the credentials of the parties. Pending applications, if any, also stand disposed-of. As requested by Mr. Nandwani, since the respondent is stated to be a senior citizen and currently residing in Bangalore, the Registry is directed to release the amount in the name of the respondent, permitting Mr. Nandwani to collect the demand draft.

As requested by Mr. Singhal, learned counsel appearing for the appellant, in line with section 16-A of Court Fees Act 1860 (as applicable to Delhi), 50% of the court fee affixed on the appeal is directed to be refunded to the appellant. The Registry is directed to draw-up the requisite certificate in favour of the appellant within 02 weeks.
