The present petition filed under Article 226 of the Constitution of India, 1950 seeks quashing of FIR No. 372/20231 registered under Sections 307/34 of the Indian Penal Code, 1860 at P.S. New Ashok Nagar and all consequential proceedings emanating therefrom. 2.
The instant petition is premised on a purported settlement between Petitioners and Respondents No. 2 and 3 as evidenced by Compromise Deed dated 21st July, 2023. Affidavits of Respondents No. 2 and 3 confirming the factum of settlement are also annexed with the petition. 3.
As observed by this Court on the previous date, Respondent No. 3 has passed away. Respondent No. 2, the son of Respondent No. 3, along with 1 "the impugned FIR"

the wife of Respondent No. 3, are present in Court. They oppose the settlement and do not agree to the quashing of the impugned FIR. 4.
In light of the foregoing, counsel for Petitioner seeks leave to withdraw the present petition, with liberty to take recourse to appropriate remedies, in accordance with law.

Leave and liberty, as prayed for, are granted. 6.
In the event, there is a genuine settlement between parties, Petitioners shall be free to re-apply for appropriate orders, in accordance with law. 7.
Dismissed as withdrawn.

It is clarified that the Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
