The present petition raises a grievance as regards the alleged illegal and unauthorized construction raised in property bearing No.54, Khasra No.252/1, Chaudhary Patram Awana Marg, Meethapur Village, Near Mahesh Awana Kothi, Badarpur, New Delhi-110044.

Learned counsel for the MCD, who appears on advance notice, submits that the property in question has already been booked for unauthorized construction and demolition action is scheduled to be taken on 05.06.2024. 3.

It is assured and undertaken, on instructions, that requisite steps shall be taken on the said date to remove/demolish the unauthorized construction in the property in question.

In view of the aforesaid statement of learned counsel for the MCD, the petitioner does not wish to press the present petition at this stage. The same is accordingly, dismissed as withdrawn, however, taking on record the aforesaid statement of learned counsel for the MCD.

Needless to say, any action taken by the MCD shall be subject to the statutory/appellate remedies of the owner/occupier of the property in question.

In case there is any deficiency in the action taken by the MCD, the petitioner shall be entitled to take appropriate remedies in accordance with law.
