The plea of Mr. Bhargava is that the respondents should extend the benefit of the judgment of the Supreme Court in the case of Director (Admn. And HR) KPTCL & Ors. versus C.P. Mundinamani & Ors. in Civil Appeal No. 2471/2023 decided on 11.04.2023. 2.

Mr. Bhargava, reiterates the prayers as sought in the writ petition. 3.

The counsel appearing for the respondents states that each case need to be looked/considered on facts to ensure that the said case is covered by the judgment of the Supreme Court.

Noting the said submission(s) made, we dispose of the petition with a direction to the respondents to consider the writ petition as representation on The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. behalf of the petitioner in terms of the judgment of the Supreme Court referred to above and dispose of the same within a period of ten weeks. 5.

If the petitioner is entitled to the benefits as per the judgment of the Supreme Court, the same shall be released to him within a period of six weeks thereafter.

In the eventuality, the respondents are of the view that the petitioner is not entitled to the benefits as sought, reasons thereof, shall be communicated to the petitioner in writing, and the petitioner shall be at liberty to seek such remedy as available in accordance of law.

The petitions stand disposed of.
