IN THE HIGH COURT OF DELHI AT NEW DELHI
+ BAIL APPLN. 244/2016 MOHD ASIF @ RAJA ..... Petitioner Through :
Mr.Haneef Mohammad, Advocate.
versus STATE ..... Respondent Through :
Mr.Tarang Srivastava, APP.
CORAM:
HON'BLE MR. JUSTICE S.P.GARG
O R D E R
% 14.03.2016 1.
The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.903/2015 registered under Sections 307/34 IPC at PS Khajuri Khas. Status report is on record.
2.
I have heard the learned counsel for the parties and have examined the file. Counsel urged that no specific role has been assigned to the petitioner and he has been falsely implicated in this case.
3.
Perusal of the file reveals that the petitioner had earlier filed bail application 200/2016 which after some arguments he opted to withdraw with liberty to file afresh. Vide order dated 27.01.2016, the Co-ordinate Bench permitted the petitioner to withdraw the bail application with liberty prayed for.
The petitioner has failed to furnish any change of circumstances to consider the second BAIL APPLN. 244/2016
anticipatory bail application on similar grounds. As per status report, specific role has been assigned to the petitioner. The nature of injuries has been opined 'grievous'.
Charge-sheet has since been filed.
4.
Considering the gravity of the offence and serious allegations against the petitioner, no sufficient ground for grant of anticipatory bail. The bail application is dismissed.
