The senior counsel for the petitioner on instructions seeks to withdraw the petition with liberty to make the challenge as made herein either in the appeal under Section 10F of the Companies Act, 1956 proposed to be filed against the order dated 31st December, 2015 of the Company Law Board and which appeal lies before the High Court of Madras or if need be by way of a separate petition against the Reserve Bank of India (RBI) before the High Court of Madras so that the issues as raised in this petition can be considered by the same Bench / Court.

The petition is dismissed as withdrawn with liberty aforesaid. 3.

The senior counsel for the petitioner states that the petitioner would also be making a representation to the RBI in this respect. No costs.
