Learned Counsel for the Petitioner seeks permission to withdraw the present Writ Petition with liberty to file a fresh Writ Petition seeking directions to Respondent No.1 to remove encroachments which has not been done despite the order dated 16.08.1989 passed by the SDM for removal of Obstruction/Nuisance from the common Gali/Street, and other subsequent Orders and notices.

Leave and liberty, as sought for, is granted. 3.

The Writ Petition is disposed of as withdrawn along with the pending applications, if any.

It is made clear that this Court has not made any observations on the merits of the case.
