After hearing arguments for some time, learned Senior Counsel for petitioner/plaintiff, on instructions, submits that, without prejudice to his rights and contentions, he does not press the present petition. He, however, submits that since the controversy is now very narrow and since possession has already been received back by the plaintiff, learned Trial Court may be requested to expedite the trial.

It is also informed that the matter is fixed before the learned Trial Court tomorrow, for framing of issues.

Be that as it may, in view of the aforesaid statement, present petition is disposed of as not pressed.

Admittedly, petitioner/plaintiff is, primarily, relying upon the lease deed with respect to adjacent property and also two other properties. Since the dispute is now, merely, with respect to determination of use and occupation charges, learned Trial Court is requested to make best endeavour to dispose of the case, as expeditiously as possible, preferably within six months from today.

Needless to say, both sides would render their due assistance and co-operation in this regard to the learned Trial Court.
