% 20.09.2019 Crl. M.A. 36463/2019 Vide the present application, the applicant/complainant seeks direction thereby to take on record the additional facts. It is stated in the present application that the applicant/complainant has now planned to arrive in India and she will be available from 15.10.2019 to 24.10.2019 in India. Accordingly, she is willing to depose before the learned Trial Court during the aforesaid period.
Considering the fact that the matter is more than 10 years old and there is already a direction from the Hon'ble Supreme Court vide order dated 11.02.2019 to expedite the trial of the case, this Court directs the Trial Court to fix two consecutive dates between 15.10.2019 to 24.10.2019 for crossexamination of the applicant.
Accordingly, the present application is allowed and disposed of. CRL.M.C. 3320/2019 In view of order passed in Crl. M.A. 36463/2019, no further direction is required to be passed in the present petition and the same is accordingly disposed of.
I hereby make it clear that if any bailable warrant, pending against the applicant is set aside and the Trial Court shall examine the witness on the date fixed for hearing.
