% 12.02.2016 Present writ petition has been filed seeking quashing of the letter dated 17th October, 2015 issued by the respondent-school, whereby admission was denied to the petitioner on the ground that he was a fee defaulter in the year 2014-2015 and had not attended school during the academic session 2015-2016.
It has been averred in the writ petition that the petitioner's father had made a representation dated 19th October, 2015 to the respondents that he was willing to pay all the outstanding arrears. Learned counsel for the petitioner states that the child is young and if he is not granted re-admission in the school, he will suffer immense hardship and trauma.
Learned counsel for the respondent-school states that the school has no objection to re-admitting the petitioner, but he points out that the student has not attended any class in the present academic year.
However, keeping in view the fact that the petitioner had not attended the school because he was not in a position to pay the school fees, this Court directs the respondent-school to grant re-admission to the petitioner forthwith in the same class in which he was studying i.e. class 8. The petitioner is directed to make payment of the outstanding fees within a period of one week.
Respondent-school is further directed to allow the petitioner to sit in the annual examination for class 8.
With the aforesaid directions, the present writ petition stands disposed of.
