This is an application seeking modification of the order dated 02.02.2018.

The petitioner now states that respondent no.3 company, namely, M/s Villa Realtors Pvt. Ltd. has operated its bank account and, to that extent, the statement made before this Court was erroneous. He states that the said statement was made due to some miscommunication between the petitioner nos. 1 and 2 and the counsel appearing on that date. 3.

The order dated 02.02.2018 was passed only on the basis of the statement made on behalf of the petitioners that the bank accounts of respondent no.3 are not operational. In view of the above, the order dated 02.02.2018 is recalled.

It is also seen that petitioner no.3 is a director in respondent no.4

company and petitioner no.4 is a director of respondent no.5 company. Also, petitioner nos. 1 and 2 are directors of respondent no. 3 company and are not directors of respondent nos. 4 or 5. It is seen that the petitioners have clubbed their causes of action, which is impermissible. 5.

The learned counsel appearing for the petitioners seeks to withdraw the present petition with liberty to file afresh. 6.
