None appears for the petitioner when the matter is called out. 2.
Mr. Mayank Bamniyal, learned counsel appearing for the respondent has drawn the attention of this Court to the order dated 29th July, 2022, wherein it was recorded as under:
"Learned counsel for the petitioner submits that the petitioner has expired during the pendency of the present petition. He seeks some time to file an application to implead the legal representatives of the deceased petitioner. Liberty is granted to the petitioner to file an appropriate application in this regard.
List on 20.02.2023."

Learned counsel appearing for the respondent submits that despite the fact that the petitioner had expired long back, no steps have taken to implead the legal representatives of the deceased petitioner. 4.

prayer for conversion of the subject property from leasehold to freehold. However, the lease of the subject property has already been cancelled way back on 22nd March, 2002.

Learned counsel appearing for the respondent submits that the lease of the subject property has not been restored thereafter. He further submits that the cancellation of the lease on 22nd March, 2002 has also not been challenged on behalf of the petitioner.

Thus, considering the aforesaid facts, it is clear that there is no question of converting the subject property from leasehold to freehold, when the lease of the subject property is not even subsisting. 7.
Accordingly, the present writ petition is dismissed in default and nonprosecution, as also for the reason that the present petition is without any merits.
