% 09.03.2018 By this petition the petitioner seeks a writ of mandamus to the respondent Nos. 1 to 5 to investigate upon the representation/complaint of the petitioner dated 16th May, 2017 and any other order that this Court may deem fit.

Petitioner made a complaint alleging fraud by Om Prakash Sawariya, his wife Durgi @ Mamta, brother Vinod Sawariya, brother in law Saty Narayan @ Satya Narain and his wife Sunita for causing wrongful loss to the complainant after inducing him for delivery of goods of ₹4,34,05,598/-. Learned proxy counsel for the learned Additional Standing Counsel W.P.(CRL) 424/2018

for the State submits that on 7th March, 2018 FIR No. 37/2018 has been registered under Sections 409/420/120B IPC.

Learned proxy counsel for the State on instructions for the Investigating Officer, submits that during the investigation if any other offence is found to be made out or any other victim is found to be involved, the same will also be associated with the FIR in question and a charge sheet will filed after the completion of the investigation, if offences are found to be made out.

Taking the statement of learned counsel for the State on record, petition is disposed of.
