% 09.03.2018 By way of this writ petition, regularization from back date is sought by petitioners' counsel while relying upon decision of a Division Bench of this Court in W.P.(C) 5715/2017 titled The Secretary, Ministry of Health and Family Welfare & Ors. v. Shri Khageswar Padhan and Ors., rendered on 11th July, 2017.

There is an office objection regarding the maintainability of this petition.

Even in the case of Khageswar Padhan (supra), the concerned employees had approached the Central Administrative Tribunal in the first instance and thereafter, had approached this Court. In the Appendix VI to Rule 154 (b) of the Central Administrative Tribunal Rules of Practice, 1993, the contesting respondent-Indian Council of Medical Research finds mention.
