The present petition has been filed alleging willful disobedience of the order dated 11th September, 2023, passed by Division Bench of this Court in W.P.(C) 11929/2023.

By the aforesaid order dated 11th September, 2023, the Division Bench had passed directions, in the following manner: "xxx xxx xxx

Mr. Pathak, who appears for the respondent no. 1 states that the application filed by the petitioner is barred by time as Section 28-A contemplates such an application need to be filed within three months. Having noted the said submission, the fact of the matter is that the petitioner having made an application, the same need to be decided by the Land Acquisition Commissioner.

5. We dispose of the writ petition by directing the respondent no. 1 to consider the application dated 09.06.2022 of the petitioner and pass order in accordance with law within a period of 8 weeks from today.

6. Suffice to state that we have not expressed ourselves on the plea of Mr. Pathak. The petition stands disposed of." 5.

Mr. Sanjay Kr. Pathak, learned counsel appearing for the respondent, submits that a further period of eight weeks, may be granted to comply with the directions passed by the Division Bench.

At this stage, learned counsel appearing for the petitioner submits that personal hearing may also be granted to the petitioner. 7.

Considering the aforesaid, it is directed that the application dated 9th June, 2022, submitted by the petitioner, shall be considered by the respondent, within a period of eight weeks from today. 8.

At the time of consideration of the application of the petitioner, the petitioner shall also be granted a personal hearing. Thereafter, a reasoned order shall be passed in terms of the directions issued by the Division Bench, vide order dated 11th September, 2023. 9.

With the aforesaid directions, the present petition is disposed of. 10.

However, liberty is granted to the petitioner, to approach this Court in case the grievance of the petitioner still survives.
