Learned counsel for the petitioners submitted that the Kalandra dated 27.9.2013 under Section 145 of the Code of Criminal Procedure, 1973 is pending in the Case No.565/SDM/N/13 before the Sub Divisional Magistrate (SDM) concerned for more than six years and the main grievance of the petitioners is that the matter is not being decided expeditiously by the Court of SDM.

Learned counsel for the petitioners further submitted that the petitioners are ready to withdraw the petition in case the SDM concerned is directed by this Court to expedite the proceedings and decide the matter within three months.

Accordingly, as prayed, the petition is dismissed as withdrawn with the direction to the SDM concerned to decide the matter as expeditiously as possible, preferably, within six months from today. Pending applications are also dismissed as withdrawn. CHANDER SHEKHAR, J JULY 17, 2019/rk
